Terri Ann Noe Incident and DUI Arrest Details:
In the early morning hours of Saturday July 6, 2013, Terri Ann Noe was involved in a minor fender bender at N. Military Trail and Okeechobee Blvd in Palm Beach County, FL. After refusing breathalizer testing, the offficer conducted a series of feild sobriety tests including:
- Walk and Turn [FAIL]
- One Leg Stand [FAIL]
- Finger to Nose [FAIL]
- Resite Alphabet [FAIL]
Ovservations by arresting officer Brelsin:
"When I spoke with her [Terri Noe] I noticed that her speech was slurred. She had apparently become upset and was crying because I notice her eye makup was running down her cheeks. When I requested her to perform roadside sobriety tasks she readily agreed and exited her car. I asked her to stand at the rear of her car so I could get organized but she had trouble following basic instructions."
"Instead of standing by her car she began to dance around and raised her arms away from her body. She then appeared to be loosening up in an exercise kind of way. "
"I relocated her to the sidewalk area for the tasks, an area that was adjacent to the parking lot and level. When she walked she was very unstable, she used the wll of the building next to the sidewalk to help her maintain her balance."
Terri Noe stated "I have been drinking. I'm not going to deny that."
The arresting officer noted that Terri Noe was "initialy cooperative, but at time of arrest became aggressive and angry."
On October 2, 2013, the defendant pled guilty to the charge of Driving Under the Influence (DUI). The defendant was adjudicated guilty. The sentence imposed was 12 months probation, $500 fine, $451 of court costs and 70 hours of community service.
The sentence included the folowing stipulations:
- No alcohol consumption
- Random alcohol/drug testing
- Driver's license suspended/revoked
- DUI school
- Ignition interlock
- Victim impact panel
- Vehicle immobilization
